By using somehowfunctional.com, the blog, the resources page, or any tool hosted here ("the Tools"), you agree to these terms. If you don't agree, don't use the site. We've tried to write this in plain language; where legal precision required otherwise, we kept it as short as we could.
1. Who can use this
You must be at least 18 years old, or the age of majority in your jurisdiction if higher.
2. What this site is — and isn't
somehowfunctional.com provides a blog and resources page with harm-reduction-oriented writing, and self-contained tracking tools that run entirely in your browser and produce estimates from published research.
The Tools available may change over time. Each Tool has its own in-app disclaimers and Sources & Corrections section covering what it calculates and its known limitations.
This site is not a medical device, a substitute for professional advice, a guarantee of accuracy, or a monitoring/compliance/reporting tool. Read the Disclaimers before using any Tool — in particular, do not use a Tool's output to decide whether it's safe to drive, dose, combine substances, change medication, or delay emergency care.
3. No accounts
There is no account system. Your Tool data lives in your browser's local storage and is your responsibility — backing it up, protecting the device it's on, and understanding that clearing browser data or switching devices means starting over unless you exported a backup.
4. User-submitted content
This section applies to anything you post through a public-facing feature of the site — comments or community features, if and when they are enabled ("User Content"). It does not apply to your Tool data, which never reaches us, or to messages you send us through the contact form, which are private correspondence and are covered by Section 5.
a. It's public. Anything you post in a public feature is visible to anyone, and can be read, copied, quoted, screenshotted, and indexed by search engines. We can remove content from the site; nobody can remove it from the internet once others have seen it. Post accordingly — especially here, where the subject matter is personal. Pseudonyms are welcome.
b. You keep ownership. You give us a limited license. You retain all rights in your User Content. By posting it publicly, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, reformat, display, and distribute that content for the purpose of operating the site and displaying your content to other users.
c. The license ends when you delete. If you delete your User Content, or ask us to remove it, this license ends for live display and we will remove it from the site. It survives only to the limited extent necessary for: (i) copies in routine backups, for the length of our normal backup cycle; (ii) content other users have already quoted or replied to; and (iii) retention required by law or to resolve a legal claim. We do not keep a right to keep publishing something you've taken down.
d. We will not use your personal disclosures to promote the site — no pull-quoting someone's story about their drinking into an ad, a social post, or a landing page — unless you specifically agree to it. If we want to feature something you wrote, we'll ask.
e. Your promises. You represent that you own or have the rights to what you post, that it doesn't infringe anyone's rights, and that it complies with the Code of Conduct and applicable law.
f. We're not responsible for it. User Content reflects its author, not us. We do not pre-screen everything, we don't endorse it, and nothing another user posts is medical advice.
g. We can moderate. We may remove, edit, restrict, or decline to publish User Content at any time under the Code of Conduct, including without prior notice where safety requires it.
5. Feedback
If you send us technical feedback about the site or Tools — bug reports, model corrections, feature suggestions — you agree we may use it without restriction or compensation, so that we don't need a signed agreement to fix a bug you pointed out. We'll credit good ideas where we reasonably can.
This does not apply to personal disclosures. If your message tells us about your own use, health, or circumstances, that part is private correspondence, not feedback we may use. We won't publish it, quote it, or use it to promote the site.
6. Acceptable use
You agree not to:
- use the site or Tools for any unlawful purpose
- interfere with, disrupt, or gain unauthorized access to the site, its infrastructure, or other users' devices
- scrape at scale, harvest user content, or reverse engineer for malicious purposes
- engage in click fraud or ad-stack abuse (blocking ads in your own browser is your business; defrauding advertisers is not)
- violate the Code of Conduct in any community feature
- misrepresent a Tool's output as an official, certified, or forensically admissible result
- impersonate anyone, or misrepresent an affiliation with us
- use the contact form in bad faith (spam, abuse, harassment)
7. Intellectual property
The site's design, original written content, and the specific implementation of the Tools are owned by the site's operator unless otherwise noted. The underlying pharmacokinetic, biomarker, and tracking models are drawn from published, publicly available research; we claim no ownership of the science, only our particular implementation and presentation of it.
The Tools' source code is not currently released under an open-source license; all rights are reserved. If that changes, the applicable license will be stated in the repository and will govern.
Nothing in this section limits fair use or any other right you have under copyright law. You do not need our permission to quote, cite, criticize, report on, or reference this site — including in research. If you want to do something bigger (redistribute a Tool, build a derivative, use content commercially), get in touch via the contact form; we're generally easy to work with.
8. Copyright complaints
No community features are currently enabled, so no user-uploaded content exists. If you believe content we have published infringes your copyright, contact us via the contact form with: identification of the work, the URL of the material, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your signature. We will review and respond.
Before enabling any feature that lets users post content, we will designate a DMCA agent, register that agent with the U.S. Copyright Office, and publish the agent's name, address, phone number, and email here, along with a full counter-notice procedure, a repeat-infringer policy, and a restoration process. We are not claiming DMCA safe harbor until that is actually in place.
9. Advertising and third-party services
No advertising is currently running on this site. If we introduce it, it will appear on general pages only. Ads will not appear on any Tool page or its wrapper, and not on pages that reveal a specific substance, condition, medication, or diagnosis — see the Privacy Policy for the full boundary, the reasoning, and the conditions under which the wrapper boundary could change. The Tool interface itself will never carry advertising. We use Cloudflare Web Analytics (cookieless) on general pages only.
Ads are not endorsements; we don't select individual advertisers, and your dealings with an advertiser are between you and them. Third-party providers operate under their own terms and privacy policies.
10. No warranty
The site and Tools are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
In particular: any Tool output is an estimate from a population-level model, not a measurement of you, and it can be wrong. We do not warrant that the site will be uninterrupted or error-free, that a Tool will prevent any harm, legal consequence, health outcome, or test result, or that User Content or third-party links are accurate.
11. Limitation of liability
To the fullest extent permitted by law, the site's operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of or inability to use the site or Tools.
You are responsible for your own decisions, including any decision informed by a Tool's output. Please read the Disclaimers.
To the extent liability cannot be excluded, our total aggregate liability for all claims is limited to the greater of (a) what you paid us in the twelve months before the claim (currently nothing — the site is free) or (b) fifty US dollars ($50).
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, gross negligence, willful misconduct, or any non-waivable rights you have under consumer protection law. Some jurisdictions do not allow certain exclusions; where that's so, the above applies only to the maximum extent permitted.
12. Indemnification
If you post User Content, misuse the site, or violate these terms or the law, you agree to indemnify and hold harmless the site's operator from claims, damages, losses, and reasonable legal fees arising from that conduct. This section applies to that conduct only — simply reading the site or using a Tool as intended does not trigger it.
13. Third-party links
The resources page and blog link to external organizations, hotlines, and services we don't control. We try to keep details current but aren't responsible for the content, availability, or practices of third-party sites.
14. Termination
You can stop using the site at any time; your local Tool data stays on your device. We may suspend or terminate access to community features for violation of these terms or the Code of Conduct. Sections that by their nature survive termination do — including the User Content license (as limited by Section 4c), warranty disclaimers, limitation of liability, indemnification, and governing law.
15. Changes
We may update, modify, discontinue, or add Tools at any time. Discontinuing a Tool doesn't delete your local data but may mean no further updates or support.
We may update these terms. For minor changes, continued use after the updated date constitutes acceptance. For material changes — in particular, introducing accounts, community features, or a change to how data is handled — we will post a visible notice and, where the change materially affects your rights, ask for fresh acceptance rather than relying on your continued use.
16. General
Governing law and venue: these terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles, and the state and federal courts located in Maryland will be the venue for disputes. This does not deprive you of the protection of mandatory consumer-law provisions, or the right to bring a claim in the courts of your country of residence, where applicable law gives you that right.
Severability: if a provision is unenforceable, the rest stands, and that provision is narrowed to the minimum extent necessary. Entire agreement: these terms, the Privacy Policy, the Disclaimers, and the Code of Conduct are the entire agreement about the site. No waiver: not enforcing a provision isn't a waiver of it. Assignment: you may not assign these terms; we may assign them in connection with a transfer of the site, and would say so publicly.
